The United States' primary ocean regulatory body is encountering significant criticism from environmental organisations over planned modifications to a longstanding rule designed to protect the critically endangered North Atlantic right whale. The National Oceanic and Atmospheric Administration (NOAA) intends to announce proposed new regulations that would modernise existing protections, a move described as a deregulatory-focused action aimed at reducing economic burdens.

Controversial Shift in Conservation Policy

The existing vessel speed rule, a cornerstone of right whale conservation for years, mandates that large ships slow down in specific zones along the East Coast during certain periods to prevent deadly collisions. With fewer than 400 North Atlantic right whales remaining, these collisions represent a leading cause of mortality for the species. NOAA's forthcoming proposal seeks to implement new technologies and engineering approaches while easing regulatory pressures on maritime industries.

Environmental groups have reacted with alarm to this policy shift, particularly following the recent confirmed death of a three-year-old female whale off the coast of Virginia on February 10th. While the exact cause of death remains undetermined, the loss of a young female—vital for the species' future reproduction—has intensified concerns. "Another female right whale, the future of this species, has lost her life. We urgently need more right whale protections, not fewer," stated Jane Davenport, senior attorney at Defenders of Wildlife.

Historical Context and Industry Pressure

North Atlantic right whales undertake an annual migration from calving grounds off Florida and Georgia to feeding areas near New England and Canada. This journey leaves them highly susceptible to ship strikes and entanglement in commercial fishing gear. Once abundant along the East Coast, the population was devastated during the commercial whaling era and has been under federal protection for decades.

The previous Biden administration had proposed expanding slow zones and including more vessel classes under speed restrictions, but this initiative was withdrawn in its final days due to the volume and complexity of public comments. Meanwhile, shipping businesses and marine industry groups, such as the National Marine Manufacturers Association, have consistently opposed the speed rules, labelling them archaic and advocating for technological solutions instead.

NOAA's statement to The Associated Press emphasised that the agency remains committed to ensuring responsible conservation practices. A notice of rulemaking is currently listed on the U.S. Office of Information and Regulatory Affairs website, though specific details of the proposal are not yet available. The agency has promised that further information will be released shortly, highlighting a focus on advanced tools to safeguard the whales without imposing undue economic strain.
