Kim Kardashian Faces Backlash Over Legal Fee Demand in Misidentification Case
Reality television star and business mogul Kim Kardashian is encountering significant pushback after demanding that a New York man pay back the legal fees she accumulated following a lawsuit he filed against her. The controversy stems from Kardashian misidentifying the man as a death row inmate during one of her social media posts focused on criminal justice reform.
The Legal Battle Unfolds
Ivan Cantu, a resident of Westchester, New York, has requested a court to dismiss a $145,000 financial demand from Kardashian, whose net worth is estimated to exceed $1.9 billion. In a filing reviewed by the Daily Mail on Thursday, Cantu asserted that Kardashian labeled him as a criminal to her more than 350 million followers during a particularly sensitive period in his life, leading to anxiety and depression.
Cantu highlighted that Kardashian, born into immense wealth and luxury, derives substantial income and wealth from sponsorships tied to her social media posts due to her vast follower count. He noted that while some of her posts address social causes, the majority promote sponsored products, services, and celebrity news.
The Incident and Its Aftermath
The incident occurred in February 2024 when Kardashian erroneously posted a picture of Cantu on her social media platforms. Cantu shares the same name as a Texas death row inmate who was executed on February 28, 2024, following a conviction for a double murder in 2000. Cantu subsequently sued Kardashian in February 2025, alleging that the Keeping Up with the Kardashians star published and disseminated false information that damaged his reputation.
In his legal filing, Cantu described Kardashian's posting of the incorrect picture on such a critical issue as clearly untrue, erroneous, unfounded, shocking, scandalous, degrading, disgraceful, and shameful. He sought compensatory and punitive damages for claims including libel, emotional distress, slander, invasion of privacy, negligence, and false light portrayal.
Legal Arguments and Outcomes
Attorneys for Kardashian defended the misidentification as a simple mistake arising from her longstanding commitment to criminal justice reform, noting that the image was removed almost immediately after the error was discovered. However, Cantu's attorney, Greg Sobo, emphasized in a statement to the Daily Mail that Kardashian must recognize the power of social media.
Sobo argued that social media is frequently abused to bully innocent individuals, incite harm, and injure communities, and those who cause injuries through such platforms should be held accountable, similar to those causing physical harm. He described Cantu as a very private family man with two daughters who was dealing with a personal tragedy at the time of the post, stating that the invasion of privacy caused real, lasting trauma.
A federal judge dismissed the case, ruling that Cantu failed to demonstrate he suffered any injury from Kardashian's misappropriation of his likeness. This dismissal allowed Kardashian, who is currently linked to F1 driver Lewis Hamilton, to pursue recoupment of her legal fees through the recent filing.
