Couple Avoid Jail for Leaving Baby on Beach

A Florida couple who left their six-month-old baby alone on a beach while they went for a walk have avoided jail time after entering into a deferred prosecution agreement. Brian Wilkes, 40, and Sara Wilkes, 37, were arrested in October 2025 after beachgoers spotted the infant alone on the sand at Miramar Beach and called police.

Incident Details

The parents admitted they placed their daughter under the cover of their beach tent while she napped and then took their three other children on a walk, losing track of time. Neither parent took their phones, and surveillance footage showed them walking away. The baby was left alone for at least an hour before 911 was called. When police arrived, the parents had not returned, and the infant was being cared for by Good Samaritans at a nearby hotel. Paramedics confirmed the baby was unharmed, with normal vitals.

Legal Outcome

According to court documents seen by the Daily Mail, the couple entered a deferred prosecution agreement in May 2026. They each paid $1,000 in fines, must complete 25 hours of community service, attend a parenting class, and are barred from visiting Walton County, Florida. All conditions must be met within one year, and they must avoid further legal trouble or face resumed neglect proceedings.

Major Dustin Cosson of the Walton County Sheriff's Office said the time left alone was "way longer than what would be reasonable." He warned that the beach is not a babysitter and parents must use common sense. The Florida Department of Children and Families placed all children in state custody until relatives from Texas arrived to care for them.
