Burglar Accused of Headbutting Dementia-Suffering Pensioner in Fatal Nighttime Break-In

Ashley Malcolm, 40, is on trial at the Old Bailey accused of murdering John Burke, 86, who died the day after a burglary at his home in Hackney, east London, in the early hours of September 29 2025. Malcolm allegedly headbutted Burke, who suffered from dementia, during the break-in.

Prosecutor Mukul Chawla KC described the assault as "cowardly" and said Burke died in hospital on September 30 2025 as a result. Burke lived with his 91-year-old wife Peggy in a flat on Fountayne Road.

Details of the Burglary Spree

The court heard that Malcolm broke into two homes and attempted to force his way into a third on the night of the incident. He entered Burke's flat shortly before midnight and stayed for an hour and a half, leaving with a shopping trolley of goods. He returned at 2:45am after dropping off the trolley and spent another 20 minutes inside before leaving with a box.

CCTV footage tracked Malcolm to a residential care home in Hackney at 6:25am, where he broke in. When confronted by a support worker, he ran towards him making "loud groaning noises" and reached for his waistband. At 6:55am, he attempted to burgle a flat in nearby Stamford Hill using a screwdriver.

Violent Confrontations

When a female resident challenged Malcolm, he reacted violently. Her husband came downstairs with a bicycle pump and shouted, “If you come back to my house, you will see what will happen.” Malcolm allegedly replied, “I rob you before, p*ssyhole.” He then took the bicycle pump and attacked the man with it before punching him on the ground.

After the assault, Burke gave multiple accounts to a nurse, paramedics, police, and family. He told a healthcare worker he had been "beaten up" and "attacked." Paramedics were told he had been headbutted by two men but was too afraid to leave his bedroom to call 999.

Medical Evidence and Trial

Burke was discharged from hospital after tests, but the following morning his son found him unconscious on the floor. An ambulance crew suspected a bleed on the brain. Evidence includes CCTV, police body-worn video, forensics, post-mortem examinations, and CT scans.

Malcolm denies assaulting Burke. Chawla said: "The prosecution say that the defendant violently headbutted Mr Burke. You will have to consider the fact that such an assault was committed against an obviously frail and vulnerable man of advancing years."

Malcolm, of Hackney, has admitted burgling Burke's home, another burglary, and attempted burglary. He denies murder, manslaughter, and assault causing actual bodily harm. The trial continues.
