The hearing, which lasted approximately one hour, saw attorney Rocco Cipparone vigorously defend his client, Ashley Fisler, against serious charges of sexual assault and misconduct.

Details of the Allegations and Arrest

Ashley Fisler, who was employed at Orchard Valley Middle School for nine years, was arrested on March 23 after the alleged victim claimed they were involved in a sexual relationship in 2021 while he was her student. Prosecutors allege that the relationship included sexual encounters at least six times, with incidents occurring in her vehicle and classroom. The case has drawn significant attention due to the graphic nature of the accusations and the age of the student involved.

Defence Arguments and Text Message Evidence

A central focus of the hearing was the examination of over 7,500 text messages exchanged between Fisler and the boy. Cipparone contended that the boy's texts were 'as graphic and direct as any I've seen from an adult', suggesting he was not an innocent party. 'I'm not saying he's not the age he is, but this is not a babe in the woods scenario that Ms. Finley is creating from a risk and a danger perspective,' Cipparone stated, accusing prosecutors of selectively presenting messages to worsen the appearance of the situation.

However, Gloucester County prosecutor Kylie Finley countered that other messages allegedly showed Fisler offering to shave the boy's pubic hair, buy him sex toys, ask for descriptions of his sexual encounters with peers, request photos, and recommend provocative movies. Finley also asserted that the boy attempted to end the relationship multiple times, but Fisler persisted, with one message from the teen stating she 'stripped me of my innocence'.

Investigation and Charges

Investigators confirmed in January that the relationship was inappropriate after reviewing the messages, which detailed numerous sexual encounters. An affidavit cited by NJ.com revealed that nude photographs of Fisler were sent to the victim. Despite this, Cipparone argued there was no evidence proving sexual assault occurred before the boy was a teenager.

Fisler faces severe charges, including:

  • Six counts of first-degree sexual assault of a minor
  • One count of second-degree endangering the welfare of a child
  • One count of second-degree official misconduct of a public servant

She has denied all allegations in a statement to authorities on March 19. If convicted, she could face up to 20 years for the sexual assault charges and an additional 10 years for the second-degree charges.

Ashley Fisler remains incarcerated at Salem County Jail as Judge William Ziegler deliberates on whether she can be released on bail.
