The Nursing and Midwifery Council (NMC) tribunal heard that the conversation occurred on July 22, 2022, in front of other colleagues and could have been overheard by patients. The panel described the exchange as "highly inappropriate and unprofessional conversation of a sexual nature involving children." Another colleague testified that she found the conversation "really disgusting," noting it was particularly upsetting due to unknown personal backstories.

Mr Murray argued that his comment was "misinterpreted" and a "joke," stating that neither he nor his colleague were the authors of it. He insisted they were only repeating or interpreting a joke. However, the tribunal panel rejected this defence after reviewing evidence, including investigation notes and oral testimonies.

The panel concluded that the conversation extended beyond a single joke into a wider discussion with further sexualised remarks involving children. It determined that whether the words were original or repeated was not relevant to the factual issue at hand. The panel found that Mr Murray did say those words and chose to engage in the conversation, demonstrating a serious lack of judgment.

In its ruling, the tribunal emphasised that such language has no place in a professional healthcare setting. It stated the conduct was capable of causing shock and distress to colleagues, risked reputational damage to the nursing profession, and was inconsistent with the standards expected of a registered nurse. The panel also noted an earlier incident on the same day where Mr Murray swore and made an offensive gesture at a charge nurse during a discussion about Covid-19 staffing protocols.

Ricky Gervais responded to the ruling on social media platform X, denying he had ever said anything similar in his comedy sketches, screenplays, stand-up routines, or privately. This contradicted Mr Murray's claim that the remark originated from the comedian.

As a result, James Murray was suspended from nursing practice for six months, highlighting the NMC's commitment to upholding professional conduct and protecting public trust in healthcare services.
