Upskirter spared jail for Tube station crimes

An Ecuadorean man who loitered around London Tube stations to take illicit pictures up women's skirts has been spared an immediate prison sentence. Luis Ortega, 66, targeted one victim while she was waiting for the Hammersmith and City Line at London King's Cross on August 31, 2024.

Incident at King's Cross

Prosecutor Claire Langevad told Inner London Crown Court that the victim became aware of a man standing extremely close behind her. 'She could hear him breathing and could feel him moving closer,' Langevad said. 'She felt a hand on the back of her thigh in what she describes as a slow stroking motion.' When the victim turned around and saw Ortega filming up her skirt, she confronted him, saying: 'Oh my God, you're taking a video up my skirt, delete it now.'

Further evidence uncovered

Ortega initially denied wrongdoing, claiming he was filming the station. However, police analysis of his phone revealed three additional photos taken up women's skirts: one on August 23 at Liverpool Street station, another the same day at King's Cross, and a third the following day. Ortega later admitted his actions and expressed remorse, stating that his wife and family could not know about his arrest.

Indecent images of children found

A search of Ortega's home led to the seizure of his devices. On his iPad, police discovered one Category A and two Category B indecent images of children. The father-of-three was assisted by a Spanish interpreter throughout the sentencing hearing.

Defence and sentencing

Mitigating for Ortega, Alec Williams said his client had lived in the UK since 1995, working as a carpenter, and felt ashamed for his actions. Judge Matthew Boyle referenced the victim's statement, noting she felt 'annoyed and disgusted.' He described Ortega's behaviour as 'creepy, intrusive and completely unacceptable.' However, the judge accepted that the offences were out of character and that Ortega had expressed deep shame and regret.

Ortega received a nine-month prison sentence suspended for 18 months. He must also complete 30 days of a rehabilitation activity requirement and 100 hours of unpaid work. Additionally, he was issued a ten-year Sexual Harm Prevention Order and will be subject to notification requirements. The judge warned: 'Make no mistake, if you commit any further offences you will be going straight to prison. I am giving you a chance here. It is the only chance you are going to get.'

Ortega pleaded guilty to two counts of possession of indecent images of children and four counts of recording an image under clothing without consent.
