Upon arrival, they found both defendants present along with a young child. Initially, the male defendant was described to officers as the child's uncle, but this explanation quickly unraveled when police observed concerning interactions between the man and the infant.
Suspicious Behavior Leads to DNA Testing
Prosecutor Kyle Padley detailed how officers became suspicious when they heard the child refer to the male defendant as "daddy" while the man himself called the infant "my kid" during the incident. This contradictory information prompted authorities to order immediate DNA testing to establish the true biological relationships.
The forensic results proved devastatingly conclusive. The DNA test revealed that the two defendants were indeed half-siblings who share the same mother, and that the child was biologically theirs. This scientific evidence strongly suggested they had engaged in sexual activity together, despite their familial connection.

During the prosecution's opening remarks at North Staffordshire Justice Centre, the male defendant became visibly distressed and emotionally overwhelmed. Both defendants had previously admitted to engaging in penetrative sexual activity with a relative, acknowledging their unlawful conduct. Sarah Bedford, representing the female defendant, presented a complex picture of her client's background and circumstances. She informed the court that her client had been adopted at birth and raised primarily within the care system, only meeting her biological mother and half-brother as an adult.
"She is a profoundly remorseful individual with no previous convictions who presents no risk of reoffending," Ms Bedford stated. "She is the sole carer of the child, who is at the heart of these proceedings. These are quite emotional proceedings for all who are involved."
The defense lawyer described her client as a hard-working mother and single parent who is typically well-behaved, noting that "it's unfortunate that she finds herself in this position." Ms Bedford explained that her client had been suffering from significant insecurity at the time of the incidents, and that alcohol consumption had played a contributing role in the events.

Magistrates issued an arrest warrant for the male defendant following his removal from the courtroom. The female defendant received a £443 fine after the bench carefully considered all aspects of the case.
The magistrates stated: "We have listened carefully to everything that has been said. This is a very unpleasant and difficult situation for everyone involved. We have considered the recommendation of imposing a community order, but there doesn't appear to be anything you could or should be working on. We also don't see any benefit in imposing a Sexual Harm Prevention Order."
The defense had argued against custodial sentencing, suggesting that the custody threshold had not been crossed in this case. Ms Bedford emphasized that her client would have to live with the consequences of these events for the rest of her life, and that she presented no threat to public security.
