The Danger of 'Challenges' and Inadequate Moderation

Beyond the algorithm, the suit highlights the platform's role in promoting dangerous viral 'challenges'. While many are harmless fun, others have led to serious injury and even death. The lawsuit accuses TikTok of failing to act with sufficient speed or force to remove or suppress such hazardous trends, prioritising virality and engagement over user safety.

Furthermore, Minnesota alleges that TikTok's age-rating on app stores is deeply misleading, presenting itself as a safe, 12+ environment while knowingly hosting content that is anything but.

What Minnesota Demands

  • A complete audit and external oversight of its algorithm to ensure it does not unfairly target minors.
  • The immediate termination of all accounts belonging to under-13 users, with a verified and robust age-gating system to replace it.
