Financial Controller Caught in Marriage Fallout
Kevin Chiu, who served as group financial controller and company secretary for Cannon-Brookes Services until February last year, allegedly became entangled in the bitter aftermath of the couple's separation in July 2023. The marriage had lasted thirteen years before its dramatic collapse.
A statement of claim filed with the Supreme Court of New South Wales accuses Mr Chiu of leaking hundreds of confidential documents to Annie Cannon-Brookes during this turbulent period. The documents reportedly included sensitive employee HR files containing personal information about staff members.
Defence Claims Instructions Came from Wife
While Mr Chiu admits to downloading 966 confidential files, his defence presents a startling counter-argument. He claims Annie Cannon-Brookes explicitly told him to obtain the documents, and he complied believing it formed a normal part of his employment duties.
The allegations specify that on or about November 14, 2024, Mr Chiu downloaded employment contracts, remuneration and bonus details, resumés, tax and superannuation records, medical certificates, visa and police check details, and committee minutes. These comprehensive HR files allegedly contained deeply personal information about employees.
Alleged Sharing of Confidential Information
Court documents further allege that between December 20, 2024 and January 10, 2025, Mr Chiu shared these HR files with both Annie Cannon-Brookes and former CBC chief financial officer Catherine Manuel. The company additionally accuses him of leaking invoices, bank statements, US tax details concerning sports team investments by Cannon-Brookes Entertainment Group, and particulars of financial dealings with Grok Investments.
Mr Chiu has categorically denied the core breach allegations, maintaining that providing access to Annie Cannon-Brookes did not constitute unauthorised disclosure. He insists his actions fell within the scope of his professional responsibilities.
Employment Contract and Legal Violations
According to the statement of claim, Mr Chiu was employed from May 18, 2020 until February 4 last year. Cannon-Brookes Services alleges he violated his employment contract, which required him to maintain strict confidentiality, use information solely for performing his duties, and avoid any usage that could harm the company, its officers, employees, or the Cannon-Brookes family.
The company further accuses Mr Chiu of breaching his statutory duty under the Corporations Act. This legislation prohibits company officers from improperly using corporate information to gain advantages for themselves or others, or to cause detriment to the company.
Termination and Legal Proceedings
During a meeting with new CFO Faris Cosic on February 4 last year, Mr Chiu allegedly admitted to the HR files conduct. The company responded by issuing a 'Deliver Up Direction' requiring him to return all devices and provide passwords and access codes. Mr Chiu reportedly refused this demand via text message.
Cannon-Brookes Services terminated Mr Chiu's employment on February 4 last year and commenced legal proceedings against him on February 18. The company is seeking damages and indemnity costs for the alleged breaches. Meanwhile, Mr Chiu has filed a counter-claim seeking financial compensation arising from interim court orders.

The technology billionaire recently suffered an almost $1 billion reduction in net worth as competitors developed new artificial intelligence tools that threaten his business software products.
Atlassian's shares plummeted eight percent on the NASDAQ last week, dropping to US$68.17 (AU$97.43). This represents more than a two-thirds decline from the stock's peak of US$242 (AU$345.88) within the previous fifty-two weeks.
