This development adds to the mounting pressures on the California representative, who recently suspended his gubernatorial campaign amid separate sexual misconduct accusations.

Complaint Filed by Controversial Filmmaker

The claim was detailed in a 68-page complaint submitted to federal immigration officials in February by Joel Gilbert, a California filmmaker who describes himself as "the conservative Michael Moore." Gilbert has a history of producing conspiratorial content, including a documentary mailed to voters in 2012 that promoted baseless theories about Barack Obama's parentage. He denies being a Republican operative, stating, "I just kind of follow the truth where I see it."

However, Gilbert's work has clear partisan aims. In 2012, he faced a Federal Election Commission complaint alleging his film Dreams from My Real Father violated campaign finance laws by acting as an undisclosed contribution to Mitt Romney's campaign. With assistance from prominent conservative lawyer Cleta Mitchell, Gilbert argued the film was journalism, leading to a 3-3 split decision by the FEC.

Swalwell's Legal and Political Troubles Intensify

Swalwell's decision to halt his gubernatorial bid on Sunday did not alleviate the scrutiny he faces. A sexual assault allegation from 2024 has prompted the Manhattan district attorney's office to open a criminal investigation. Additionally, members of Congress from both parties have indicated they might vote to expel Swalwell, along with Republican Representative Tony Gonzales, who is also accused of misconduct.

The DHS investigation focuses on whether Swalwell and his wife violated immigration law by hiring a Brazilian woman without a work permit to care for their children. Gilbert's complaint includes extensive research into public records and social media profiles of the Swalwells and their nanny.

Gilbert's Pattern of Targeting Political Enemies

Gilbert acknowledged that his investigations typically target individuals defined as enemies by Donald Trump. His research has earned him platforms on outlets like Infowars and Roger Stone's radio show. He frequently writes for the conspiratorial website the Gateway Pundit and has scoured mortgage records of various public figures, including Letitia James and Chuck Schumer.

Gilbert also took credit for inspiring a criminal referral against Swalwell last year for alleged mortgage and tax fraud, filed by Bill Pulte, the partisan head of the Federal Housing Finance Agency. This referral highlights the ongoing political dimensions of these allegations.

As the DHS investigation proceeds, Swalwell's legal and political future remains uncertain, with multiple probes and bipartisan calls for accountability shaping the narrative.
