Widow of Slain NYPD Officer Breaks Down as Murder Trial Begins in Queens
The heartbroken widow of a hero New York City police officer killed in the line of duty wept uncontrollably as his alleged killer appeared in court for the start of a murder trial. Stephanie Diller was forced to leave the courtroom twice to compose herself as graphic details of her husband's fatal injuries were described by prosecutors.
Graphic Details Emerge in Courtroom Testimony
During the opening statements at the Queens court, prosecutor Ken Zawistouski explained how a bullet allegedly fired by defendant Guy Rivera, 35, "ripped through" Officer Jonathan Diller's abdomen during a routine traffic stop in Far Rockaway on March 25, 2024. The court heard how the projectile struck underneath Diller's bulletproof vest, severing his iliac artery—one of the body's most vital blood vessels—and causing catastrophic internal damage.
"The bullet ripped through his abdomen and, in the last moments of his life, he ripped the gun from the killer's hands," Zawistouski told jurors, prompting emotional reactions throughout the courtroom. Dozens of Diller's NYPD colleagues attended the proceedings, with many becoming visibly distressed as the prosecutor described how Rivera allegedly "chose violence" when confronted by police.
Defense Claims Police Responsibility for Officer's Death
While prosecutors presented their case that Rivera fired three rounds from the passenger seat of a Kia Soul, striking the 31-year-old officer in the stomach, defense attorney Erin Darcy offered a starkly different account. In her opening statement, Darcy claimed that the New York Police Department—not her client—was responsible for Diller's death.
The defense attorney asserted that a police sergeant at the scene caused "an unintentional discharge" while attempting to remove Rivera from the vehicle, which Diller had noticed was suspiciously parked at a bus stop. Rivera, who appeared in court wearing a pumpkin-colored suit with an orange tie, was himself shot and wounded during the fatal confrontation but denies the first-degree murder charge against him.
Haunting Evidence Presented to Jurors
Jurors were shown disturbing bodycam footage capturing the moments of the shooting, during which the father of a one-year-old son can be heard crying out, "I'm shot!" The prosecution emphasized that Rivera had alternatives to violence, noting he could have surrendered his firearms peacefully—with one weapon reportedly tucked in his jacket pocket and another in the vehicle's glove compartment.
"The defendant had choices. That day, he chose violence," Zawistouski reiterated, highlighting what he characterized as a deliberate decision to use lethal force against a police officer performing his duties. The emotional toll on Diller's family was palpable throughout the proceedings, with Stephanie Diller struggling to maintain her composure as the detailed account of her husband's final moments unfolded.
