Speeding Driver Grins Outside Court Before Jailing for Fatal Crash
Footage has emerged showing an "arrogant" driver smirking outside court just moments before being jailed for causing the death of a young woman by dangerous driving. Dean Tolan, 36, from Birley, Sheffield, was captured grinning as he arrived at Sheffield Crown Court for sentencing, where he later sobbed in the dock upon receiving a nine-year prison term.
Moments of Contempt Before Sentencing
The video clip shows Tolan appearing to use the hands-free function on his phone while smirking, joking with others, and carrying a large overnight bag as he waited to enter the building. This display occurred shortly before he pleaded guilty to causing the death of 29-year-old Ellie Smart in a horror crash on January 25, 2024.
Judge Jeremy Richardson KC condemned Tolan's behaviour, stating he showed an "errant disregard and arrogance" for the rules. The court heard that Tolan was speeding at 58 miles per hour when he hit Ms Smart as she attempted to cross the road, and he was not wearing his glasses despite licence conditions requiring corrective eyewear.
Devastating Impact on Victim's Family
In a gut-wrenching statement, Ms Smart's parents revealed their heartbreak after "watching her slip away" hours after the crash. They described how their daughter, a first-class communications graduate who worked in South Yorkshire Police's office, had visited them on the morning of the incident.
The family, who lived a short distance from Ms Smart, felt compelled to leave the city due to the trauma. They expressed devastation that she will never marry, have a family, or watch her niece grow up, highlighting the profound loss caused by Tolan's actions.
Legal Consequences and False Claims
Prosecutor Laura Marshall detailed that Tolan's driving licence was only valid when wearing corrective glasses or contact lenses, a restriction he ignored at the time of the collision. He failed multiple roadside eyesight tests and falsely claimed he had only noticed emerging eyesight issues days before the crash.
Additionally, Tolan's mobile phone was connected to his vehicle's Bluetooth, with records showing he used it within seconds of the crash. Judge Richardson noted Tolan's "spectacular arrogance" during police interviews, where he attempted to blame the deceased, the DVLA, and his optician.
Attempts to Shift Blame
The hearing revealed that Tolan even sought to blame Ms Smart after her death, alleging she rushed out in front of him and left him no chance to brake. Judge Richardson rebuked this, stating, "You caused the death of a delightful young woman aged 29 years who had her whole life ahead of her. You eradicated that."
Alongside the nine-year jail sentence, Tolan was banned from driving for 10 years, underscoring the severity of his dangerous driving and the tragic outcome for Ellie Smart and her family.
