The judge stated that Lake "satisfies the requirements of neither the statute nor the Constitution" to hold her position.

In his Tuesday order, Judge Lamberth accused Lake of having "repeatedly thumbed her nose" at legal requirements established by Congress to properly staff the agency. He described her actions as a "flagrant and nearly year-long refusal" to comply with statutory obligations.

Mass Layoffs and Agency Dismantling

Under Lake's direction, the U.S. Agency for Global Media took dramatic steps to dismantle Voice of America operations:

  • More than 1,000 staff members were indefinitely placed on leave during what became known as "bloody Sunday" at the agency
  • The director of Voice of America was fired
  • Virtually all full-time workers were laid off
  • A deal was made to carry content from right-wing media network One America News Network

Judge Lamberth noted that without assessing operational needs, the agency "immediately began winding down the agency to only skeletal operations." He declared all actions taken under Lake's direction to be "void."

An activist judge is trying to stand in the way of those efforts at USAGM. Judge Lamberth has a pattern of activist rulings – and this case is no different."
