Legislative Attempt to Outlaw Incestuous Marriages

State Representative Dean Black, a Republican, spearheaded the initiative to ban all incestuous marriages through an amendment to a bill concerning changes to Florida's Department of Health. In a statement to Action News Jax, Black emphasized, "There are plenty of people here, and there are plenty of people you can find to be your lifelong partner without looking to your first cousin."

The bill explicitly stated, "A man may not marry any woman to whom he is related by lineal consanguinity... A woman may not marry any man to whom she is related by lineal consanguinity." If enacted, incestuous marriages entered into after July 1 would not have been recognized "for any purpose in this state."

Reasons for the Bill's Failure

The legislation ultimately failed due to time constraints in the legislative session. Black noted that disagreements over other components of the bill prevented its passage before the session ended. He expressed hope for future efforts, stating, "I think a ban on first cousin marriages should come back whether it's a standalone bill, whether it's tagged onto some other bill. Not really sure. We'll have to see."

Black underscored the importance of this issue, adding, "I think we need to do the right thing for Floridians here."

Florida currently bans marriage between most family members but permits unions between first cousins. According to Action News Jax, Florida is one of 16 states in the United States with no limitations on marrying a first cousin. This legal status remains unchanged following the bill's failure.
