Carpenter Escapes Prison with Suspended Sentence in Drug Trafficking

A carpenter who was described as 'terrified' of incarceration has walked free from court with a fully suspended sentence, following a supportive character reference provided by a police officer friend. Benjamin John Dobson, aged 23, admitted to drug trafficking offences in the Sunshine Coast suburb of Wurtulla, spanning from October 6, 2023, to May 22, 2024.

Details of the Drug Offences

Dobson pleaded guilty to trafficking cocaine at a street level, supplying the drug to 17 customers on a weekly basis, with transactions valued up to $2,100. Additionally, he admitted to six separate counts of supplying drugs between November 2021 and May 2024. The court heard that Dobson sourced the cocaine from a father-and-son duo, Kim Andrew White and Marshall Andrew White, who are currently facing 31 charges related to dangerous drugs and weapons possession as alleged leaders of a large Sunshine Coast drug syndicate. Neither of the Whites has entered a plea at this time.

Court Proceedings and Sentencing

During the sentencing at the Supreme Court in Brisbane, defence barrister Steve Dickson argued that Dobson's arrest had been a sobering experience. He stated that his client was 'simply terrified' of the prospect of prison and had turned his life around since the offences. Dickson explained that Dobson had succumbed to peer pressure, using the profits from drug sales to fund his own habit, and initially believed he was merely supplying friends without fully comprehending the severe consequences.

The court considered a character reference from Dobson's police officer friend, which played a role in the sentencing decision. Justice Soraya Ryan acknowledged the defendant's fear of jail, noting that while the criminal justice system would fail if judges avoided prison terms solely due to a defendant's fear, she decided to show leniency in this case. She sentenced Dobson to four years' imprisonment, suspended, for the trafficking offences, and 16 months, also suspended, for the six counts of supplying drugs.

Justice Ryan's Remarks

Justice Ryan addressed Dobson directly, stating, 'This must be heartbreaking for your parents and other people in the court supporting you.' She recognised his efforts to distance himself from negative drug influences and his terror at the thought of incarceration. However, she also highlighted the challenges within the trades industry, remarking, 'If you are a tradie you are going to know that there are drugs everywhere, in your employment peer group and it is not easy to stay away from them.'

Evidence presented in court included social media posts depicting Dobson's jet-setting lifestyle, with photos showing him partying in Bali, travelling in business class, handling firearms, and even riding on a jet ski with Marshall White. These images contrasted sharply with the serious nature of the charges and the court's focus on his rehabilitation and fear of prison.

The case underscores the complexities of sentencing in drug-related offences, where character references and personal circumstances can influence judicial outcomes, even in the face of significant criminal activity.
