In a brazen attempt to defraud the legal system, two friends from Essex concocted a plot straight out of a television drama, swapping identities for a crucial DNA test. Their goal was simple: to avoid thousands of pounds in child maintenance payments.

The Elaborate Scheme Unravels

Scott Ambrose, 29, was legally required to undergo a paternity test after being named as the father of a child. Facing a significant financial commitment, he enlisted the help of his close friend, Simon Fernandez, 32. The pair hatched a plan where Fernandez would pretend to be Ambrose and provide the DNA sample instead.

The deception was initially successful. Fernandez attended the appointment, presented himself as Ambrose, and the test results subsequently excluded the real Scott Ambrose as the biological father. This would have absolved him of any financial responsibility.

Justice Prevails: The Plot Exposed

However, their scheme quickly fell apart. Investigations revealed inconsistencies, and the truth emerged. Both men were charged with conspiracy to commit acts tending to pervert the course of public justice.

Appearing at Chelmsford Crown Court, the pair faced the consequences of their actions. The judge, Her Honour Judge Mary Loram KC, did not mince words, condemning their "serious" and "premeditated" attempt to undermine the family justice system.

The Sentence: A Narrow Escape

In a turn of fate, both Ambrose, of Loughton, and Fernandez, of Waltham Abbey, were handed a ten-month prison sentence. Yet, in a display of judicial leniency considering their guilty pleas and personal circumstances, the sentence was suspended for 18 months.

They walked free from court but under strict conditions. They must complete 200 hours of unpaid work and adhere to a three-month curfew, electronically monitored between 7pm and 7am.

This case serves as a stark warning that the courts will not tolerate such calculated attempts to deceive and manipulate the legal process for personal gain.
