A saleswoman who alleged she endured a night of horrific abuse at her company's Christmas party, including discussions of a "midget throwing" contest, has lost her employment tribunal case after missing the legal deadline while holidaying in the United States.

Shocking Allegations from Drunken Work Event

Gill Parkinson, a 51-year-old Business Development Manager standing at 4ft 11in, claimed she was subjected to sexual harassment, inappropriate touching, and offensive disability-related remarks during Yell Sales Limited's Christmas party in Newcastle in December 2022. The tribunal heard disturbing details about the evening's events, which allegedly included colleagues making deeply offensive comments about her height and disability.

One trainer reportedly shouted across the restaurant: "Gill, how much disability do you claim a month?" before adding, "Well, you know she's a dwarf so she should be able to claim." The same individual allegedly inquired about Ms Parkinson's sex life, referencing her husband's height of 6ft 3in.

Multiple Incidents of Alleged Misconduct

The tribunal was presented with several serious allegations from the evening:

  • Another colleague repeatedly shouted that he wanted to charge bar patrons to throw Ms Parkinson around "like they do with midgets"
  • A third man was accused of rubbing Ms Parkinson's leg, breasts, and bottom while attempting to kiss her
  • Another colleague allegedly spent the evening discussing how he and other fathers from his children's nursery had talked about raping staff members they knew personally

Internal Investigation and Subsequent Actions

Ms Parkinson raised a formal grievance with Yell management on December 21, 2022, prompting an internal investigation that upheld some of her complaints. She later indicated in March 2023 that she would not appeal the grievance decision but raised a further complaint against one individual in September 2023 before resigning from her position in October that year.

During her employment at Yell, Ms Parkinson had been promoted from Business Development Manager to Senior Account Manager in October 2022, just two months before the controversial Christmas party took place.

Missed Deadline During American Vacation

Employment Judge Anderson, sitting in Manchester, dismissed all of Ms Parkinson's claims after determining she had missed the crucial three-month legal deadline for filing her tribunal case. During this critical period, Ms Parkinson had secured new employment and embarked on a trip to the United States, visiting Las Vegas, the Grand Canyon, and San Francisco.

Despite Ms Parkinson's insistence that the journey represented a recuperative visit to family rather than a holiday, Judge Anderson noted she had described the Las Vegas portion of her trip as "amazing" in a text message. The judge acknowledged Ms Parkinson's claim that she had attempted suicide in January or February 2024—the very period during which she could have filed her tribunal claim—but found no medical evidence to corroborate her account of mental health struggles.

Judge's Sympathetic but Firm Ruling

Judge Anderson expressed "genuine sympathy" for Ms Parkinson regarding her allegations, describing the sexual harassment and disability discrimination claims as "particularly serious." However, he determined that her mental health challenges, while believed to be genuine, did not constitute sufficient justification for missing the statutory deadline.

The ruling emphasizes the strict procedural requirements of employment tribunals, where even compelling allegations can be dismissed if claimants fail to adhere to filing deadlines. The case highlights the difficult balance tribunals must strike between accommodating genuine personal circumstances and maintaining consistent application of legal time limits.
