California Sheriff Escalates Ballot Seizures in Defiance of State Officials

Republican Riverside County Sheriff Chad Bianco, who is currently running for governor of California, has dramatically escalated his conflict with state officials by ordering the seizure of additional ballot materials. This move comes despite mounting legal challenges and criticism from Democratic leaders who assert his investigation into alleged voter fraud is entirely baseless.

Unprecedented Seizures and Legal Battles

On Tuesday, Sheriff Bianco directed his office to confiscate 426 boxes of ballot materials from a recent special election. This action follows his previous seizure of approximately 650,000 ballots from last year's special election, which has already placed him at the centre of significant legal controversy. The sheriff's office claims these seizures are part of an ongoing criminal investigation into voting discrepancies.

California's Democratic Attorney General, Rob Bonta, has filed a lawsuit against Bianco, accusing him of initiating "a sweeping and unprecedented criminal investigation" based on "facially insufficient" evidence. Bonta's office has raised serious concerns about the legality of the search warrants obtained by the sheriff and warned that such a weak investigation could severely undermine public trust in election oversight.

Disputed Claims and Political Context

The investigation was reportedly prompted by claims from a local group called the Riverside Election Integrity Team, which alleged a discrepancy of 45,896 votes between official results and handwritten ballot counts. However, state officials have clarified that the actual difference was merely 103 votes, dismissing the allegations as unfounded.

Attorney General Bonta has firmly rejected the claims of widespread voter fraud, stating: "There is no indication, anywhere in the United States, of widespread voter fraud. Counts, recounts, hand counts, audits, and court cases all support this." Meanwhile, Bianco is one of two Republicans competing in California's gubernatorial primary, which features over half a dozen Democratic candidates.

Court Rulings and State Condemnation

A three-judge panel recently denied Bonta's emergency request to halt Bianco's ballot recount, suggesting the attorney general should pursue the matter through lower courts. Simultaneously, the UCLA Voting Rights Project has filed a separate lawsuit with the California Supreme Court on behalf of voters, seeking an immediate stay of the sheriff's investigation.

California Secretary of State Shirley Weber has also condemned Bianco's actions, stating last week: "The Riverside county sheriff's office has taken actions based on allegations that lack credible evidence and risk undermining public confidence in our elections." Weber emphasised that while the sheriff's assertion that his deputies know how to count is admirable, they lack expertise in election administration.

Online Rhetoric and Office Defence

An investigation by Democracy Docket revealed that Bianco has previously promoted anti-voting rhetoric online. Apparent comments on his LinkedIn profile included statements such as: "That's why some people should never be allowed to vote," and accusations that Democrats "have created an environment where cheating and illegal voting is keeping them in office."

Bianco's office has vigorously defended his actions, releasing a statement on Friday claiming: "The attorney general's office has taken massive steps, at taxpayers' expense, to prevent a lawful investigation from occurring." The statement added: "This is exactly why Californians are sick and tired of the California government; it is corrupt and no longer working in the best interests of Californians."

Broader Implications for Election Integrity

The lawsuit filed by the UCLA Voting Rights Project specifically seeks to block Bianco's recount of last year's vote on Proposition 50, a measure to redraw California's congressional districts in ways that favoured Democrats. Proposition 50 was introduced by Governor Gavin Newsom in response to Donald Trump's efforts to gerrymander additional Republican seats in red states and was passed overwhelmingly by voters last November.

Voters involved in the lawsuit have warned: "Every day the sheriff fails to comply with the attorney general's directives, the attorney general is injured in his ability to carry out his duties as the state's chief law officer." They have urgently called on the state's supreme court to intervene and halt the investigation immediately.
