An official stated that nations relying on US assistance while refusing to reject the ICC's authority would face increased scrutiny, possibly including sanctions, travel bans, and visa revocations. The Trump administration had already imposed sanctions on ICC officials, including Chief Prosecutor Karim Khan, for investigations into Israel's conduct in Palestine and US activities in Afghanistan.

Legal Experts Criticize Rubio's Remarks

Three international legal experts described Rubio's remarks as a mischaracterization of the ICC's powers. Kenneth Roth, former executive director of Human Rights Watch, noted that the ICC does not claim jurisdiction over conduct in the United States and accused Rubio of seeking impunity for American war crimes under the guise of national sovereignty. The ICC can only investigate crimes committed in states that are party to the Rome Statute, which the US has not ratified.

Hypocrisy in US Policy

Critics point out that the Trump administration has welcomed ICC investigations into Russian war crimes in Ukraine but opposes investigations into Israel and US activities. The ICC has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant. Raed Jarrar of Dawn advocacy group stated that Rubio's attack undermines access to justice globally and could amount to obstruction of justice under the Rome Statute.

Potential Impact on ICC Operations

The former senior US government sanctions official suggested that the campaign might pressure foreign counterparts to take action against the ICC and that the administration may sanction the tribunal as a whole, preemptively targeting any ICC action regarding Venezuela. Such measures would prevent Americans from working with the ICC and risk penalties for doing business with the court.
