Teenager Secures Damages Following Festival Crowd Crush Incident

A 19-year-old woman has been awarded a four-figure sum in damages after sustaining a severe knee injury when she was pinned against a security fence during a crowd surge at the popular TRNSMT Festival in Glasgow. The incident occurred in July 2023 as Jennifer Gatherer waited in a holding area ahead of a performance by chart-topping artist Becky Hill.

Chaotic Scene Led to Serious Injuries

Jennifer Gatherer, a hospitality worker from East Kilbride, Lanarkshire, had been queuing for two hours at the front of the crowd when delays in opening the stage created dangerous congestion. According to her legal representatives at Digby Brown Solicitors, the situation escalated when security guards removed a fencing panel to allow entry to the arena.

The subsequent surge of movement caused the panel to threaten collapse, prompting security personnel to push it upright against the advancing crowd. This action trapped Miss Gatherer against the barrier, resulting in significant injuries including torn ligaments and extensive soft tissue damage throughout her leg.

Lengthy Recovery and Life Disruption

The aftermath of the incident proved devastating for the teenager. She required immediate medical attention, first at the festival's first aid tent and subsequently at Wishaw General Hospital's Accident and Emergency department. Medical staff confirmed the severity of her injuries, necessitating a knee splint and crutches for five months.

"I couldn't walk, I couldn't even clean myself without help – it was mortifying," Miss Gatherer revealed. "I was just physically and emotionally shattered by the whole thing from the crush to my recovery – there wasn't a single part of my life that wasn't affected by this."

Her injuries forced her to miss six months of work and abandon a planned seven-day family holiday to Turkey scheduled for the following week.

Legal Action and Settlement Details

Digby Brown Solicitors pursued legal action against three companies responsible for crowd safety at the event: DF Concerts & Events, ESM Operations, and G4S. The law firm argued that proper infrastructure was lacking and that staff failed to follow established risk assessments.

Furthermore, CCTV evidence reportedly showed opportunities to allow earlier arena entry that could have prevented the dangerous crowd build-up. While all three firms denied liability, the case settled out of court this month for an undisclosed four-figure sum.

The settlement was reached with DF Concerts and ESM Operations accepting responsibility on a 50/50 basis, while G4S was released from the action. Notably, Miss Gatherer stated she has never received an apology from any of the involved parties.

Industry Warnings About Crowd Safety

David Wilson, a partner at Digby Brown, emphasized the critical importance of proper crowd management at music events. "Gigs and festivals can be rowdy but that's precisely why crowd control measures exist," he stated. "Proper risk assessments, trained staff, safe practices and appropriate fencing and infrastructure ensures risk is minimised and music fans – no matter their physical size – are able to enjoy the experience safely."

Both DF Concerts and ESM Operations were approached for comment regarding the settlement and the safety concerns raised by this incident. The case highlights ongoing challenges in managing large-scale public events and the serious consequences when crowd control protocols fail.
