A lawyer representing imprisoned election denier Tina Peters has publicly supported the extraordinary idea of deploying the US military to secure his client's release from prison.

Attorney Peter Ticktin made his controversial comments during an appearance on Steve Bannon's War Room podcast on Tuesday 25 November 2025. When asked whether former President Donald Trump should dispatch the celebrated 101st Airborne Division to free Peters, Ticktin responded: "Do I think it should be done? For who I am, yeah – I'd love to see that happen."
The 70-year-old disgraced former Mesa County, Colorado clerk is currently serving a nine-year prison sentence after being convicted in August 2024 on seven out of ten charges, including four felonies. Her crimes involved allowing an associate of MyPillow CEO and Trump loyalist Mike Lindell to access a secure room to copy a hard drive containing data from the state's 2020 presidential election results.
Background of the Case and Political Fallout
Peters' actions were committed in support of Donald Trump's unproven claims of election fraud, which attempted to discredit Joe Biden's victory. Despite maintaining her innocence, District Court Judge Matthew Barrett delivered a stern rebuke during her sentencing hearing last October, stating: "You are no hero. You're a charlatan who used, and is still using, your prior position in office to peddle a snake oil that's been proven to be junk time and time again."
Nevertheless, Peters has become a cause célèbre within the MAGA movement. Trump himself directed the Department of Justice in May to take action securing her release and subsequently threatened Colorado with "harsh measures" if she remained imprisoned. The administration requested her transfer to federal custody earlier this month, citing health concerns.
A bipartisan group of Colorado county clerks responded by issuing a rare joint statement to Democratic Governor Jared Polis, urging resistance to the federal call and accusing him of betraying election workers through his silence. Escalating Rhetoric and Official Responses
On Sunday, Trump repeated his demand for Peters' release on Truth Social, writing in all capitals: "FREE TINA PETERS, WHO SITS IN A COLORADO PRISON, DYING & OLD, FOR ATTEMPTING TO EXPOSE VOTER FRAUD IN THE RIGGED 2O20 PRESIDENTIAL ELECTION!!!"
While Governor Polis hasn't addressed the growing pressure campaign, Colorado Attorney General Jenna Griswold has been unequivocal. In a statement issued on Friday, she affirmed: "Tina Peters stands alone as an example of the nefarious actions and outcomes of election denialism. Her deliberate and criminal actions were perpetrated in support of Donald Trump's 'Big Lie'. She violated Colorado law and her duty to administer Mesa County elections."
The situation has grown increasingly tense, with local MAGA podcaster Joe Oltmann calling for the execution of Polis and other state officials over their handling of the Peters case, suggesting they should "hang by their neck until dead."
Peters continues to maintain her conspiracy theories, claiming voting machine manufacturer Dominion possesses "vote flipping software" the day after her conviction last year.
