The shooter's initial ChatGPT account had been terminated in June 2025 following a violation of OpenAI's usage policy. While automated systems detected the account and flagged it for human review, company officials determined at that time that the activity did not meet the threshold for law enforcement referral.

"Based on what we could see at that time the account was banned in June 2025, we did not identify credible and imminent planning that met our threshold to refer the matter to law enforcement," O'Leary explained in the correspondence.

Enhanced Safety Commitments

OpenAI has committed to strengthening its detection systems to better prevent attempts to evade safeguards, with particular emphasis on identifying high-risk offenders. The company will also develop a direct point of contact with Canadian law enforcement and enhance protocols for contacting authorities when conversations indicate imminent and credible threats.

"With the benefit of our continued learnings, under our enhanced law enforcement referral protocol, we would refer the account banned in June 2025 to law enforcement if it were discovered today," O'Leary affirmed.

British Columbia Premier David Eby revealed that OpenAI CEO Sam Altman has agreed to meet with him following the tragedy. Eby noted that his government was informed by OpenAI that revised protocol thresholds would have resulted in police notification about Van Rootselaar's ChatGPT activity had they been implemented earlier.
