Suspended Labour MSP Colin Smyth has been charged over allegations that a secret camera was placed in toilets within the Scottish Parliament. The 52-year-old South Scotland MSP already faces charges relating to possession of indecent images.
The new charge was reported by the Daily Record on Thursday evening. Following the development, the Scottish Parliamentary Corporate Body deactivated Smyth's parliamentary pass. Chief Executive David McGill informed MSPs by email, acknowledging the potential distress caused by the ongoing investigation and reminding staff of available support services.
Smyth was arrested on 5 August 2025 and charged in connection with possession of indecent images. He was subsequently suspended from the Scottish Labour Party, and the parliament website now lists him as an independent. He is due to appear at Dumfries Sheriff Court at a later date.
Police Scotland confirmed that officers executed a warrant at a property on Marchfield Avenue, Dumfries, on 5 August, leading to the arrest. A Crown Office spokesperson said a standard prosecution report had been received.
Following the new allegations, Presiding Officer Alison Johnstone and Chief Executive McGill confirmed that Police Scotland had swept all toilets and changing rooms in the parliament building, finding no covert recording devices. They assured building users of their safety and encouraged normal use of the premises.
In a previous statement, Smyth said the events had come as a shock and that he was co-operating fully with inquiries, asking for privacy for his family and friends.
