More than 100 maternity staff are taking legal action against Mid and South Essex NHS Foundation Trust over exposure to dangerous levels of nitrous oxide. The staff, including midwives and healthcare assistants, were exposed to the gas at Basildon University Hospital between 2018 and 2023.
Staff Report Health Symptoms
Staff reported suffering symptoms such as fatigue, anxiety, headaches, and 'brain fog' due to the exposure. An independent review found that the trust 'failed to act with candour' and had an 'unacceptable delay' in responding to concerns about the gas levels, which were first raised in July 2021.
Trust Apologises for Delay
The trust's chief executive has apologised for the delay, stating that robust systems are now in place to ensure safe nitrous oxide levels. The legal action comes as staff seek compensation for the health impacts they have endured.
Background of the Case
The exposure occurred over a five-year period, with staff unaware of the risks they faced. The independent review highlighted that the trust's response was inadequate and that more should have been done to protect employees.
This case underscores the importance of workplace safety in healthcare settings, particularly for those handling medical gases. The outcome of the legal proceedings may set a precedent for similar claims across the NHS.
