UK-wide vape sale restrictions from October 29

Retailers across the UK are preparing for sweeping nationwide restrictions on the sale of vaping and nicotine products. Later this month, Andy Burnham's government will implement several new measures limiting the availability of vapes and nicotine pouches.

New measures outlined by DHSC

Changes outlined by the Department of Health and Social Care (DHSC) include an expanded ban on underage sales, proxy purchasing offences, and strict prohibitions on promotional discounts. The upcoming rules, which will come into force on 29 October, aim to tackle youth vaping and clamp down on non-compliant trading across all retail channels.

From the end of this month, it will become strictly illegal to sell any vaping or nicotine product - including zero-nicotine vapes, nicotine pouches, strips, and pearls - to anyone under the age of 18. In England, Wales, and Northern Ireland, this replaces previous legislation that restricted only nicotine-containing liquids.

Proxy purchasing and promotional bans

It will also become an offence for any adult (aged 18 or older) to buy or attempt to buy vaping or nicotine products on behalf of a minor. Retailers will be prohibited from giving away free vaping or nicotine products or distributing coupons and substantial discounts designed to promote these items, while vending machines selling vaping and nicotine products will be subject to a complete ban in public and accessible commercial spaces.

The legislation covers a broad range of products, including vape devices, tanks, replacement coils, e-liquids (with or without nicotine), and nicotine oral pouches. Licensed medicinal nicotine replacements and medical devices are exempt from these restrictions.

Enforcement and penalties

Enforcement will be carried out by local Trading Standards officers. Retailers or individuals caught violating the age-of-sale or promotional laws face immediate £200 Fixed Penalty Notices (FPNs). Unpaid or severe cases escalated to court could result in fines up to £2,500 in England and Wales (and up to £5,000 in Northern Ireland), as well as potential prosecution for major offenses.

The upcoming changes precede the launch of the "Smoke-Free Generation" age limits in January and the rollout of mandatory digital duty stamps on retail packaging. From April 2027, all vaping products sold within UK retail will be legally required to display a valid duty stamp. Businesses operating physical storefronts or online channels are advised to update their verification procedures and point-of-sale systems prior to October 29 to comply with the updated legal requirements.
