Vaping could be banned within 15 metres of schools and nurseries in Scotland as SNP ministers explore extending smoke-free zones beyond hospitals. The move follows the Tobacco and Vapes Act 2026, which granted Holyrood enhanced powers to restrict vaping in public areas.
Scottish Labour Pushes for School Playground Ban
Scottish Labour is advocating for strict smoke-free zones, similar to those at NHS hospitals, to be applied to schools and nurseries. Jackie Baillie, the party's health spokeswoman, stated: "Kids should be able to play safely and breathe fresh, clean air at school. The SNP Government must look at how it can use the powers it has to protect kids' health and make the areas around schools and playgrounds smoke-free."
Currently, NHS hospitals enforce a 100% smoke-free policy, banning smoking, vaping, and e-cigarettes on all premises, including grounds, car parks, and vehicles. In 2022, the Scottish Government introduced a law making it an offence to smoke within 15 metres of an NHS hospital building, with fines of £50 (reduced to £30 for prompt payment). It remains unclear whether a similar approach would apply to schools.
Youth Vaping Crisis Drives Action
Despite a ban on single-use vapes introduced in 2025, teenage vaping remains widespread. A University of Stirling study found that pupils' vaping negatively impacts attendance and behaviour, with students leaving lessons to vape, contributing to truancy. Teachers reported signs of nicotine addiction among young people, spending significant time patrolling school grounds and toilets to address the issue.
Public Health Minister Maree Todd said: "The Tobacco and Vapes Act 2026 provides us with powers to expand existing smoke free spaces, as well as create vape free spaces and heated tobacco free spaces. These powers support the implementation of our Tobacco and Vaping Framework Place based actions, and we are considering how we will use the powers, ensuring action is both evidence based and proportionate. Any action will be subject to consultation and I will update Parliament with the next steps in due course."
Next Steps and Consultation
The SNP government is reviewing how to apply the new powers, with any changes to be preceded by public consultation. The Tobacco and Vapes Act 2026, passed UK-wide with Holyrood's agreement, also aims to create a smoke-free generation by banning tobacco sales to those born after 2009.
