Thomas Markle, the 82-year-old father of Meghan, Duchess of Sussex, has reportedly been admitted to a specialist dementia care facility in Florida, a move that could complicate FBI attempts to interview him over alleged child abuse material, legal experts have said.
The retired Hollywood lighting director was admitted to a £3,000-a-month “memory care” home on Friday, according to the Sun. The admission comes as reports emerged of a second hoard of alleged illicit material discovered in a storage unit near his former home in Rosarito, Mexico, following an earlier find in the Philippines.
Legal Obstacles for Investigators
Both hauls of alleged child abuse material were handed to investigators by his son, Thomas Markle Jnr. However, Thomas Snr’s move into a facility geared towards memory-loss patients presents a significant legal barrier for federal agents, it has been claimed.
Because he now lives in Florida following a leg amputation, he is subject to US law and must “knowingly and intelligently” waive his rights before giving any statements that could be used against him in court. Spencer Kuvin, a Florida-based lawyer who has represented several victims of the late financier Jeffrey Epstein, said investigators will face immediate hurdles.
“You can’t just barge into a memory care facility and conduct an interview,” Mr Kuvin explained. “Any decent lawyer would be able to get that interview struck, and the FBI know that. If someone has been diagnosed with dementia or a memory deficit, then that prevents them from knowingly waiving their rights.”
Medical and Judicial Hurdles
Mr Kuvin noted that clearing this hurdle would require an independent medical opinion confirming Thomas Snr’s cognitive capability, followed by a judge’s official sign-off. “Right now the mental health facility he is in would be able to prevent that through their physicians,” he added. “The FBI understands the difficulties they face.”
Thomas Snr has vehemently denied the allegations against him, branding them “sick lies” and publicly stating that he has never had relations with anyone under the age of 18.
Impact on the Duchess
The latest drama has cast a long shadow over his estranged daughter, Meghan, Duchess of Sussex, who is reportedly “deeply distressed” by the news. The Duchess, 45, was recently forced to issue an urgent clarification regarding a date discrepancy over when she first learned of the claims.
While her initial statement indicated she was made aware of the disturbing allegations in 2018, the Metropolitan Police later confirmed they received a letter containing claims about Thomas Snr in January 2019. Meghan reportedly wrote a final letter to her father last year to officially cut ties with him after becoming aware of the abuse allegations.
