A sexual predator followed a little girl inside her home with his trousers undone on the day he was released from prison. Mukisa Kubaya, 48, approached two young girls who were playing in their garden on July 23 this year. He had earlier been released from jail after serving a sentence for breaching a sexual harm prevention order.
Court hears of cannabis use and breach of order
Leeds Crown Court heard that Kubaya, of no fixed abode, was high on cannabis at the time. Prosecutor Zanisha Herbert told the court: "He is subjected to a sexual harm prevention order until 2031. That prohibits him from having any direct or indirect contact with any children under the age of 18. He was released from prison earlier on this day."
Between 8pm and 9pm, he was walking down a street with his trousers unfastened. He walked past an address with two young girls playing in the garden and he approached them and asked for a glass of water.
Girl's father intervenes
The court heard one of the girls, an 11-year-old, asked Kubaya to wait outside while she went and spoke to her father. Ms Herbert said: "He followed her into the address. Her father saw him with his underwear exposed and he asked for him to leave and he did so."
The girl's father asked a neighbour who said they had been met with a similar request from Kubaya, and the two went to confront him. Ms Herbert said: "Witnesses described him having been under the influence. He was arrested that day and interviewed and he said he was guilty of the offence."
Judge sentences Kubaya to two years
A pre-sentence report had been prepared, with Sean Smith, mitigating, saying: "That allows my submissions to be relatively brief in this particular case. The defendant has pleaded guilty in the lower court."
His Honour Judge Batty said Kubaya had 'checked in essentially' at his supported accommodation on the day of the offence, before going out to take cannabis. He told him: "You went and sought out an 11-year-old girl. I do take the view that this was a very serious breach, having just been released on licence. I take the view that this was very serious given what we know about you."
Kubaya was jailed for two years.
