A California appeals court on Friday upheld Harvey Weinstein's 2022 conviction for rape and sexual assault but ordered a resentencing, finding that the trial judge must reconsider the punishment. The disgraced film producer was convicted of assaulting an Italian model in her Los Angeles hotel room during a film festival and sentenced to 16 years in prison.

Court Ruling and Resentencing Order

The Second District Court of Appeal in Los Angeles ruled that while the conviction stands, the sentence cannot remain as originally imposed. The court did not specify the exact error but directed the trial judge to resentence Weinstein. Weinstein's spokesperson, Juda Engelmayer, expressed disappointment, stating, "We are disappointed by today's decision and respectfully disagree with the Court of Appeal's conclusions regarding the fairness of Mr. Weinstein's trial. At the same time, the court correctly recognized that his sentence cannot stand."

Defense Arguments for Overturning Conviction

Weinstein's attorneys, Jennifer Bonjean and Michael Freedman, had sought to overturn the conviction, arguing in a 2024 appeal motion that the trial was "doomed from the start." They claimed that the jury's knowledge of Weinstein's prior New York rape conviction during jury selection prejudiced the proceedings. They also argued that prosecutors focused excessively on Weinstein's character rather than the specific charges, introducing evidence about his alleged mistreatment of women.

Additionally, the defense alleged that the victim, identified as Jane Doe 1, provided false testimony about her relationship with film festival head Pascal Vicedomini. They asserted that she perjured herself by claiming they were merely friends and colleagues, which they argued was crucial to proving Weinstein's innocence. The attorneys contended that this testimony undermined her credibility and supported their claim that she was not in her hotel room on the night of the alleged assault.

Broader Context and Other Cases

Weinstein's legal troubles extend beyond California. In New York, he was convicted in 2020 of raping actress Jessica Mann, but that conviction was overturned in 2024 due to prejudicial testimony from women not involved in the case. Subsequent retrials ended in mistrials in 2025 and May 2026. On Thursday, New York prosecutors dropped the rape charge after Mann declined to testify for a fourth trial. Weinstein still faces a September sentencing in New York for a separate assault conviction, with prosecutors seeking a 20-year prison term.

More than 80 women have publicly accused Weinstein of sexual misconduct, allegations that sparked the #MeToo movement. He has consistently denied all claims. The California court's ruling ensures that Weinstein remains incarcerated while the resentencing process unfolds, with his California sentence to be served after any New York sentence is completed.
