According to an incident report, an officer conducting a business area check observed Nkemdiche with "many large objects, square and rectangular shapes, consistent with concealed grocery items, inside his sweatpants." The officer called for backup as Nkemdiche entered a nearby gas station, leading to his prompt handcuffing. Bodycam footage obtained by the New York Post reveals officers discovering candy bars, frozen meals, and cartons of almond milk that Nkemdiche allegedly ditched between the theft and police arrival.

During the confrontation, one officer expressed frustration, stating, "Look, man. We're not going to play these games. Because I've ran into you too many times. And you keep lying." The officer detailed how he initially gave Nkemdiche the benefit of the doubt, only to see him "take off running behind the gas station." When Nkemdiche pleaded innocence, the officer retorted, "Yes the f*** you did. Stop lying to me." Another officer noted this was her "third time" questioning him, calling it a "repeated offense."
