Prosecutors have dropped criminal charges against a Florida couple arrested after a physical altercation over a missing sex toy. Sheila Pavelec, 66, and Stanley Spink, 71, of Lake County, were each booked into jail for battery on a person 65 years and older, a third-degree felony, following the incident on June 16.
Altercation Over Missing Dildo
Pavelec flew into a rage when she could not find her dildo and accused Spink, her fiancé, of stealing it. She called police, telling officers that Spink took the device and grabbed her left forearm during the argument. She admitted to slapping him in the face and fleeing the scene.
Spink told a different version of events, saying Pavelec blamed him for the missing toy and hit him. An arrest affidavit states that Spink alleged Pavelec approached him, slapped him on the side of the head, then got in her vehicle and left. He provided an affidavit with intent to prosecute and said Pavelec was antagonizing him.
Conflicting Accounts and Injury Discrepancy
The couple had been in an on-and-off relationship for about a year before the incident. They recently got engaged on May 18th and began living together at the beginning of June, according to Spink's statement in the affidavit.
The arresting officer's statement noted that an abrasion on Pavelec's forearm "did not fit the injury" she described, as it "appeared to be fresh" and not two hours old. The affidavit reads: "Due to the inflammation and redness of the abrasion, it appeared to be fresh and did not fit the injury described approximately two hours prior."
Case Dropped by Prosecutors
As part of their bail conditions, the couple was barred from having contact with each other. However, a Circuit Court judge last month granted a defence motion allowing them to connect.
State Attorney William Gladson announced the case will not move forward, saying: "Although the evidence is legally sufficient, either the facts of the case make conviction at trial unlikely, or continued prosecution would not be an appropriate use of resources." Court documents did not confirm if the dildo was ever found or if the wedding was still on.
