Cynthia Pierce, a resident at the Lakeside at Willowbrook care facility in Harris County, was discovered deceased in her frigid room on February 16th, 2021. A criminal investigation was launched after it was revealed the facility had lost power and heat for days during the state's unprecedented cold snap.

According to Harris County District Attorney Kim Ogg, the two indicted carers, 32-year-old Annetta Nebeker and 23-year-old Tena Lactin, were responsible for Ms. Pierce's wellbeing. Investigators believe the pair failed to check on Ms. Pierce adequately or move her to a warmer area of the facility, despite being acutely aware of the dangerously low temperatures. This represents a gross dereliction of their fundamental duty of care.

Ms. Pierce's death did not occur in isolation. The historic winter storm, which crippled Texas's power grid, led to widespread blackouts. Tragically, at least ten other residents at the same facility were hospitalised for hypothermia, painting a picture of a complete operational breakdown.

This incident raises alarming questions about the preparedness and emergency protocols of care homes, not just in Texas, but globally. It underscores the critical vulnerability of elderly residents who rely entirely on others for their safety and survival during a crisis.

Both Nebeker and Lactin have been charged with injury to an elderly individual by omission, a felony offence. If convicted, they could face significant prison time.
