Kroy Biermann Files for Sole Custody in Contentious Divorce from Kim Zolciak
The ongoing and highly publicised divorce battle between former Real Housewives of Atlanta star Kim Zolciak and her ex-husband, retired NFL player Kroy Biermann, escalated dramatically this week. Biermann, aged 40, filed a formal motion in a Georgia state court on Monday, seeking sole legal and physical custody of the couple's four minor children. This legal action marks a significant new phase in their protracted separation, which began in 2023.
Allegations of Parental Neglect and Mismanagement
According to court documents obtained by the Daily Mail, Biermann's filing presents a series of serious allegations against Zolciak, aged 47. He accuses his former spouse of "blatant mismanagement of basic parenting responsibilities" that he claims "would be practically unbelievable to anyone not familiar with the circumstances." The motion requests a judge to transfer full custody from the current joint arrangement to Biermann alone.
Biermann's legal submission details specific claims of non-compliance with a temporary mediated parenting plan established earlier this year. He alleges that Zolciak failed to exercise her parenting time during an extended period from February 26 through March 29, 2024, with the sole exception being March 9. Notably, Biermann contends that on that single day, one of their minor children suffered a dog bite incident while in Zolciak's care.
The retired athlete further asserts that Zolciak entered into the temporary custody agreement "in bad faith," knowingly unable or unwilling to adhere to its terms. He labels this action as "fraud and deceit," arguing it was a tactical move to secure a joint custody arrangement she never intended to honour. Additional accusations include Zolciak permitting the children to miss scheduled therapy sessions and failing to attend the minimum required sessions with her own therapist, coupled with claims of "lying to the therapists."
Zolciak's Forceful Rebuttal and Counter-Claims
Kim Zolciak responded swiftly and vehemently to the allegations through a statement provided to the Daily Mail. Her spokesman declared, "These accusations are completely false," characterising the court filing as "nothing more than a deliberate attempt by Kroy to defame my character."
Zolciak defended her recent professional commitments, stating, "I spent five weeks away working on two TV shows to support my family and make sure my children are cared for - something I will never apologize for." She expressed a firm resolve not to be intimidated, adding, "I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent, the truth is on my side, and it will come to light - no matter how hard anyone tries to bury it."
This is not the first time financial and caregiving responsibilities have been contested. In a previous interview on Kristin Cavallari's podcast in June 2023, Zolciak publicly accused Biermann of failing to provide for their children financially, claiming he had not paid household bills "in years" and did not contribute to expenses for clothes or extracurricular activities.
Background of a Protracted Legal Struggle
The couple's separation has been a lengthy and complex legal saga. They share four minor children: sons KJ, 14; Kash, 13; and Kane, 12; as well as Kane's twin sister, Kaia. Zolciak also has two adult daughters from previous relationships, Brielle, 29, and Ariana, 24, whom Biermann later adopted.
Biermann initially filed for divorce in May 2023, with Zolciak filing shortly thereafter. After a brief reconciliation in July 2023, Biermann filed again in August 2024 and once more in early 2025. The latest custody motion follows a mediation session held on January 27, 2025, which was intended to resolve temporary child custody arrangements.
Prior custody arrangements have shifted throughout the process. After being forced to vacate their foreclosed Georgia mansion in April 2025, the exes agreed to a split-custody setup, with each parent having two children at all times on a weekly rotation. Biermann had previously petitioned for sole custody in August 2024, citing allegations of neglect and "emotional and psychological abuse," as well as a "noteworthy absence of structure and accountability" in Zolciak's home. Zolciak has also sought sole custody of the children in the past.
In his current filing, Biermann argues that Zolciak's "continued noncompliance with the Safety Plan directly jeopardizes the safety and well-being of the minor children and renders the current Temporary Mediated Parenting Plan unworkable and contrary to the children's best interests." He states he is prepared to demonstrate through "expert and witness testimony" that Zolciak is "both unstable and unfit as a custodial parent," and urges the court for an immediate grant of sole custody.
The Daily Mail has reached out to representatives for Kroy Biermann for comment on Zolciak's statements but has not yet received a response. The case continues to unfold in the Georgia family court system, with the welfare of four children at the heart of this increasingly acrimonious celebrity divorce.
