Brady Kiser, husband of influencer Emilie Kiser, will not face criminal charges following the drowning death of their three-year-old son, Trigg. The Maricopa County Attorney's Office announced the decision on Friday, two weeks after Chandler Police had recommended a felony child abuse charge.

Trigg Kiser fell into the family pool at their home in Phoenix, Arizona, on May 12 and died in hospital a week later. At the time, Brady was home alone with Trigg and the couple's newborn son, Theodore, while Emilie was out with friends.

Prosecutors stated that to pursue a child abuse charge, they would need to prove Brady 'failed to perceive a substantial and unjustifiable risk' and that his actions were a 'gross deviation from the standard of care a reasonable person would show.' After reviewing the evidence, they concluded the case did not meet the standard for a 'reasonable likelihood of conviction.'

Brady's attorney, Flynn Carey, expressed gratitude that the case was classified as a tragic accident. 'Brady remains in the midst of the grieving process and is thankful to be with his family as they heal together,' Carey said.

Emilie Kiser, 26, who has 4.1 million TikTok followers, had been posting regularly about family life before the accident. Her sudden silence sparked speculation, which was answered on May 18 when police confirmed Trigg's death. The couple has not spoken publicly since, but Emilie's lawyer issued a statement describing the incident as 'a parent's worst nightmare' and confirming it was accidental.
