Prosecutors in Australia have launched a dramatic appeal against what they describe as a "manifestly inadequate" 24-year prison sentence handed to convicted triple murderer Erin Patterson.

The 49-year-old was sentenced last month for the deaths of three relatives who consumed a deadly beef Wellington dish she prepared containing poisonous death cap mushrooms.

The Fatal Family Lunch

In July 2023, Patterson hosted a family lunch at her Leongatha home that would end in tragedy. Her former in-laws, Gail and Don Patterson, both 70, and Gail's sister, Heather Wilkinson, 66, died after eating the meal.

Heather's husband, Ian Wilkinson, 68, survived but spent nearly two months in hospital fighting for his life after receiving a liver transplant.

Prosecution's Grounds for Appeal

The Office of Public Prosecutions has filed documents with Victoria's Court of Appeal arguing that Justice Stephen Kaye's sentence failed to adequately reflect:

  • The severity of Patterson's crimes
  • The profound impact on victims and their families
  • The need for just punishment and community protection

Prosecutors contend that despite the 24-year non-parole period being substantial, it remains "manifestly inadequate" given the calculated nature of the poisonings.

While Patterson pleaded guilty to three counts of murder and three counts of attempted murder, the motive behind the poisonings remains officially unexplained. The court heard she had purchased the mushrooms from a supermarket chain and an Asian grocery store.

Justice Kaye acknowledged during sentencing that Patterson would likely be regarded as "one of the most notorious offenders in Australian criminal history." However, prosecutors believe the sentence doesn't match this notoriety.
