A Texas family has initiated legal action following the tragic death of a father who was fatally struck by a massive piece of equipment at a chemical plant in Houston. Court documents reveal that Garrick Newell, a 28-year-old contractor, lost his life on February 7 while working at a TPC Group facility.

According to the lawsuit, Newell was called to the plant to remove a bell head from a boiler maker. During this operation, a piece of equipment weighing over 1,000 pounds reportedly flew approximately 15 feet and struck him, resulting in fatal injuries. The family's attorneys, Scott Armstrong and Mo Aziz, stated that an on-site investigation indicated TPC Group failed to properly maintain its equipment, which allegedly contributed directly to Newell's death.
Allegations of Negligence and Unsafe Practices
The legal complaint, filed by Newell's widow Candice Newell, asserts that the task assigned to her husband was inherently unsafe. It claims that the unsafe operation was performed under the specific direction and control of TPC Group. Armstrong emphasized that nothing occurs at these plants without the authority and permission of the owner or operator, suggesting corporate responsibility for the incident.
This is not the first time TPC Group has faced scrutiny over safety issues. In 2019, the company made headlines after three explosions at its Port Neches facility injured multiple individuals. A report by the US Chemical Safety Board concluded that TPC neglected issues with the substances involved, lacked an effective safety management system, and caused an estimated $150 million in external damage, forcing resident evacuations.
