The shooting occurred on May 1, 2024, at Mosley Hall Farm in Whaley Bridge, Derbyshire. Marcus Smith, from Chapel-en-le-Frith, was pronounced dead at the scene from a fatal gunshot wound. Another 19-year-old also suffered gunshot wounds and was treated in hospital for his injuries.

Robert Lomas was arrested and remained on bail for 26 months while authorities investigated. On Tuesday, July 14, 2026, Derbyshire Police confirmed that he had been released without any further action.

Janine McKinney, Chief Crown Prosecutor for CPS East Midlands, stated: "This decision has been made in accordance with our statutory legal tests as prosecutors and the law surrounding the householder’s rights to defend themself. Our thoughts are with Mr Smith’s family and loved ones." The CPS reviewed a file of evidence passed by Derbyshire Police before deciding not to prosecute.

Marcus Smith was a former pupil at Chapel-en-le-Frith High School and played for local football club Chapel Town. He also worked as a DJ at his local pub. At the time of the incident, Mr Lomas's son set up a fundraiser to support the family, which raised over £60,000.

Three men arrested in relation to a burglary at the same property remain on bail, according to Derbyshire Police.
