Former CIA director John Brennan filed a lawsuit against the Trump administration on Wednesday, seeking a court order to compel officials to preserve records from investigations he claims are targeting him for 'phantom criminal conduct.' The lawsuit argues that these records are vital for Brennan to mount a defense on grounds of vindictive prosecution if he is indicted in the future.

Brennan's Legal Argument

Brennan's lawyers contend that a defense would be supported by over 100 verbal or written statements made by Donald Trump since 2017 criticizing Brennan, along with the president's directives to the Department of Justice to initiate cases 'without regard to factual or legal justification.' The lawsuit was filed in federal court in Washington, D.C.

'To fully consider those motions, the reviewing judge would need to scrutinize the motivations of the justice department officials who directed, oversaw or undertook those actions to determine whether they violated Director Brennan’s rights, and specifically whether they were motivated by a desire to vindictively prosecute him as an act of retribution,' Brennan’s lawyers wrote.

Defendants and Investigations

The lawsuit names as defendants President Donald Trump, acting attorney general Todd Blanche, FBI director Kash Patel, and prosecutors in Florida overseeing investigations related to Brennan and other former perceived Trump adversaries. One investigation examines whether Brennan made a false statement to Congress regarding a 2016 intelligence assessment on Russian interference in the presidential election. Another probes whether former law enforcement and intelligence officials conspired to undermine Trump during the Russia investigation.

No charges have been filed against Brennan. The Department of Justice has denied allegations of weaponization. The lawsuit seeks to ensure that all relevant records are preserved for potential legal proceedings.
