Daughters Blame Owner's Arrogance for Fatal XL Bully Attack on Pensioner

The grieving daughters of a pensioner mauled to death by two XL Bullies have pointedly blamed the "arrogance" of their owner, an aspiring rapper, for the horrific killing. Esther Martin, aged 68, was fatally attacked by the animals while dog-sitting at her son-in-law's residence in Jaywick, Essex, in February 2024. This tragic incident unfolded merely two days after the controversial breed was officially banned across England and Wales, highlighting a devastating failure in compliance and responsibility.

Avoidable Tragedy in a Small Essex Home

Ashley Warren, 41, had arranged for Ms Martin to care for his two adult XL Bullies, along with eight puppies of the same breed, while he departed to meet a "lady friend." The fatal assault, which occurred while a child was present in the property, left the 5ft 3in grandmother with "dozens and dozens" of severe injuries. Among these was a catastrophic bite through her right arm that severed a critical artery, leading to her untimely death.

Warren staunchly denied being the owner of a dog that caused injury resulting in death while dangerously out of control in a private place. However, after a rigorous two-week trial at Chelmsford Crown Court, a jury convicted him of this grave offence by a majority verdict of 11 to 1. This charge carries a maximum prison sentence of 14 years, underscoring the severity of the negligence involved.

Family Outrage and Preventable Circumstances

Sonia Martin-Copper, 49, has since revealed that her mother had repeatedly expressed concerns about the immense size and aggressive nature of the dogs she was left to supervise alone with a child. "We are not talking small animals. We are talking pure muscle, pure power, untrained, cooped up in a small house," she told the BBC, emphasising the wholly unsuitable environment.

Ms Martin's other daughter, Kelly Fretwell, highlighted that her mother suffered from arthritis, had undergone two hip surgeries, and walked with a pronounced limp at the time of the attack. She insisted it should have been glaringly obvious that her frail mother was utterly incapable of managing ten powerful dogs, a situation prosecutors described as an "accident waiting to happen."

Police Response and Gruesome Scene Details

Prosecutors informed the jury that the combined weight of the dog pack reached up to 190kg. Warren had made no attempt to secure an exemption certificate for his XL Bullies ahead of the ban, and the animals had not been walked for weeks, with a dog behaviour expert condemning conditions inside the home as "impoverished."

Footage from a nearby CCTV camera, presented in court, captured harrowing screams emanating from the house on Hillman Avenue, accompanied by dogs barking "in a frenzied state" around 3:30pm on February 3, 2024. The dogs were so ferocious upon police arrival that officers initially refused to enter, eventually tasering them through a broken window before shooting them dead. An officer stated they believed entering posed a risk of death or serious injury.

Child's Harrowing Account and Owner's Negligence

A child present in the house bravely attempted to hit the dogs with a broom to halt the attack, the court heard. The gruesome scene erupted moments after Ms Martin tried to separate two fighting puppies, leaving one with a bloody ear. During the commotion, the child recounted that the female XL Bully, Beauty, and the male, Bear, knocked over a suitcase blocking a bedroom door and charged into the room.

In a recorded police interview, the child explained, "Beauty and Bear knocked the suitcases over because the puppies had got into a fight. The dogs have got out and the dogs have started barking… they think something has happened to the pups because she’s protective of the pups." The child eventually fled, fearing injury, and called for help after the front door blew shut, locking them outside.

Post-Verdict Statements and Ongoing Impact

After the verdict, Judge Jeremy Johnson told Warren, "I am going to grant you bail. You should be under no illusion that it is inevitable that I will pass on you a sentence of imprisonment." Warren was ordered to surrender his passport and prohibited from leaving the country pending sentencing.

Detective Chief Inspector Louise Metcalfe, who led the Essex Police investigation, stated, "I am pleased that we have been able to ensure Ashley Warren has been held accountable but I know that no verdict will ever bring Esther back." She emphasised that Warren was illegally owning the dogs, keeping them in poor conditions, and was fully aware of Ms Martin's mobility and health issues, yet selfishly took advantage of her good nature.

This needless tragedy has profoundly affected the Jaywick community, serving as a stark reminder of the dire consequences of irresponsible dog ownership and blatant disregard for public safety regulations.
