A Florida man is taking legal action against Carnival Cruise Line, seeking more than $5 million in damages after sustaining severe burns on his feet while aboard the Carnival Magic. The incident occurred in May 2025 when Jorge Luis Alverio Nunez walked barefoot from the pool to his lounge chair on the Lido deck. He claims the surface was "unreasonably and dangerously hot," leading to second-degree burns within seconds.
According to the lawsuit, Carnival had been alerted by the deck manufacturer as early as 2014 about the risk of the surface becoming dangerously hot under certain conditions. Despite this warning, the cruise line allegedly failed to take corrective actions, such as replacing the deck material, posting warning signs, monitoring surface temperatures, or requiring passengers to wear footwear.
The legal filing further asserts that at least 25 other passengers have reported similar burn incidents on the same ship, with 42 formal complaints lodged over the past six years. In two prior cases, the burns were so severe that they reportedly led to amputations. Nunez's attorney argues that Carnival's negligence has caused life-changing injuries and seeks compensation for medical expenses, pain, and suffering.
Carnival has not yet issued a public response to the lawsuit. The case highlights ongoing safety concerns regarding deck surfaces on cruise ships, particularly in sun-exposed areas.
