Josh Miller, 29, has been sentenced to a year in prison after being caught carrying a lockback knife in Uddingston. He admitted the offence at Hamilton Sheriff Court on Friday.
Details of the incident
The incident occurred on July 11 last year in Gardenside Avenue. Prosecutor Connor McIntyre stated that police attended the area at around 2.20pm following a report of a man in distress. Officers found Miller under the influence of drink or drugs and discovered the knife in a pocket of his tracksuit top. He was arrested but not formally charged at that stage due to his level of intoxication.
Defence statement
Defence lawyer Ian Scott told the court: "He was a chaotic drug user. He is easily led and follows a bad crowd. It wasn't unexpected to find him under the influence with a knife in his possession. He has spent a lot of his adult life in a custodial setting where he is an exemplary and trusted prisoner." Miller, of Portwell, Hamilton, was living in a hostel in Uddingston at the time.
