David Kelly, 56, has been sentenced to ten months in prison for racially aggravated harassment and being drunk on an aircraft. The incident occurred on a Jet2 flight from Turkey to Newcastle on December 19 last year.
Court hears of abusive behaviour
Newcastle Crown Court was told how Kelly, from Bek Road, Newton Hall, County Durham, became inebriated and abusive during the flight. Prosecutor Saba Shan described how he initially appeared to be enjoying himself but his behaviour deteriorated as he became more intoxicated.
Kelly shouted racist slurs, performed a Nazi salute, and made a homophobic comment. He also singled out a Turkish passenger, branding him a terrorist. A young family was so distressed by his actions that they were moved from the row behind him.
Safety concerns during landing
Kelly remained standing in his seat and initially refused to fasten his seatbelt as the plane began its descent. Staff had alerted police, who arrested him upon arrival at Newcastle Airport.
Kelly, who has four previous convictions including arson and drug offences, admitted to being intoxicated on an aircraft and committing a racially aggravated public order offence.
Judge condemns conduct
Recorder David Gordon stated that those who become drunk and disorderly on an aircraft must expect an immediate custodial sentence due to the fear and distress caused and the potential safety implications. He noted that passengers and crew could not remove themselves from the confined environment and that cabin crew had to divert attention from their duties to manage Kelly's behaviour.
In defence, Brian Hegarty said his client was remorseful and that the incident began after a political disagreement with another passenger. He emphasised that Kelly did not require restraining and did not assault anyone, stating: "His behaviour was reprehensible and unpleasant but was restricted to words alone."
The court received character references for Kelly, including testimonials from a magistrate and a former Metropolitan Police officer, describing him as diligent, helpful, and community-oriented.
