Motorists have been warned that attempting to block motorcyclists who are filtering through traffic could result in penalty points, a driving ban, and a fine exceeding £5,000 if the matter reaches court. The warning comes as many drivers are unaware that filtering is legal under most circumstances.
The legality of filtering
Highway Code Rule 88 explicitly states that motorcyclists may carefully filter through stationary or slow-moving traffic. The practice is designed to ease congestion by removing motorcycles from the queue. Despite this, many riders report encountering drivers who deliberately obstruct them by pulling across or refusing to leave enough space.
Dale Gillespie, motoring expert at IronStable, said: “I see this every week on busy A-roads and in traffic jams. A lot of drivers simply don't realise filtering is legal, so they assume the rider is jumping the queue, and that's infuriating for them. But the rider's usually well within their rights, and blocking them is both against the law and dangerous.”
Penalties for obstruction
Drivers who intentionally block a filtering motorcyclist could face careless driving charges under Section 3 of the Road Traffic Act. Depending on the situation, obstruction offences may also apply. Careless driving carries three to nine penalty points, and if the case goes to court, a discretionary driving ban and a fine potentially over £5,000 could be imposed.
Limits on motorcycle filtering
Motorcyclists do not have unlimited freedom to filter. Filtering is not permitted where overtaking is forbidden, at excessive speeds, or when overtaking the vehicle nearest a pedestrian crossing. Riders must exercise care and attention at all times. Larger motorcycles, such as cruisers with broad handlebars, require more space and caution when filtering.
Gillespie added: “Motorbike filtering can be beneficial for everyone. But it only works if everyone understands the rules.”
