
A transgender woman has been handed a four-year prison sentence for sexually assaulting a man after a court found she deliberately concealed her male genitalia, thereby invalidating his consent.
Sapphire Walters, 25, was convicted at Warwick Crown Court for an assault that took place in Nuneaton, Warwickshire. The court heard how Walters, who presents as a woman, did not disclose her biological sex to the victim before the encounter.
Judge Peter Cooke stated in his ruling that the victim's agreement to sexual activity was based on a fundamental 'deception' regarding Walters's gender and physicality. "The concealment of male genitalia is a fact which would have been critical to the complainant's decision to engage in sexual activity," the judge remarked, emphasising that consent was therefore void.
