The family of a Scottish woman who fell to her death from a balcony in Benidorm in 2017 have been told by Spanish prosecutors they believe it was an accident. Kirsty Maxwell, 27, from Livingston, West Lothian, died after entering a 10th-floor apartment occupied by five British men while on a hen party weekend.
Prosecutors have informed the family that they consider the death accidental, according to David Swindle, a former detective hired by the family. However, the family rejects this conclusion, citing unanswered questions and alleging police mishandling of evidence.
Five British men from Nottinghamshire – Joseph Graham, Ricky Gammon, Anthony Holehouse, Callum Northridge and Daniel Bailey – were investigated but their lawyer, Roberto Sanchez, said they have been told there is no evidence against them. Sanchez suggested alcohol may have contributed to Ms Maxwell's disorientation.
Ms Maxwell's father, Brian Curry, criticised the police investigation, stating evidence such as his daughter's clothes were burned and CCTV footage was edited. He said: 'From the start we believe the police have been untruthful with us… Kirsty is not here so we have to be her voice.'
Mr Swindle said the case remains open as the judge has not yet closed it, and the family continues to push for further inquiries. The prosecutor's opinion can be appealed within five days, but the family insists they will not give up until all lines of inquiry are exhausted.
