Thomas Kay, a man accused of rape, has died in HMP Liverpool before his case could go to trial. Kay, from St Helens, was charged with multiple violent and sexual offences and remanded in custody last month.
Death in custody
Kay first appeared at magistrates' court on July 15 this year, but documents confirm he died inside the Walton prison two days later. The Prisons and Probation Ombudsman (PPO), which investigates all deaths in custody, confirmed his death to the ECHO.
Ombudsman Adrian Usher said: "My office is conducting an independent investigation into the death of Mr Thomas Kay on 17 July 2026, a prisoner at HMP Liverpool. I will make my final investigation report public, pending the conclusion of Mr Kay's inquest."
Prison Service statement
A Prison Service spokesperson added: "HMP Liverpool prisoner Thomas Kay died on 17 July 2026. As with all deaths in custody, the Prisons and Probation Ombudsman will investigate." The ECHO understands his death is being treated as "sudden".
Charges and legal proceedings
Court documents show Kay was due to face charges including two counts of rape, assault occasioning actual bodily harm, threats to kill, and threats to damage property. Due to the seriousness of the allegations, his case could only be dealt with at the crown court, so he had not entered pleas before his death.
Kay's case was mentioned at Liverpool Crown Court on Wednesday, but because of his death, the allegations will not be challenged in a trial, meaning the complainant will be denied the opportunity of legal justice.
The ECHO previously reported on Kay when his image was circulated as part of Operation Chapar, a wanted appeal targeting over 100 suspected offenders. There are currently six active, outstanding PPO investigations linked to HMP Liverpool, including Kay's. Six other investigations have been completed, with reports to be released pending the outcome of an inquest.
