On August 13, 2023, Avery was driving her pickup truck when a lorry rear-ended them, sending the vehicle into oncoming traffic where it was struck by another car. Carter, then 19, suffered serious head and chest injuries and was airlifted to Denton Regional Medical Center in Texas. The crash occurred about 0.8 miles south of where Presgrove's body would later be found.

Family's Suspicions

While the Oklahoma Highway Patrol has not classified Presgrove's death as a homicide, his family remains convinced he was beaten to death and his body dumped. Presgrove's sister, Maddison Rawlings, filed a wrongful death lawsuit against four friends and three parents last June, including Carter and Avery. The lawsuit alleges they supplied Presgrove with alcohol after he was already intoxicated and failed to ensure his safety. An autopsy revealed Presgrove's blood alcohol level was 0.14. The defendants have denied any wrongdoing, and the case is still in the discovery phase.
