Andy Burnham's government is set to examine the results of a public consultation on driving offences, which could lead to some drivers being banned from the road. The new Prime Minister will take over the task initiated by his predecessor, Keir Starmer's Labour government, which sought opinions on amending existing motoring offences and introducing new ones.
Consultation highlights insurance offences
Among the offences highlighted in the consultation was driving without motor insurance. The public was asked whether the maximum penalties for driving unlicensed and the minimum penalties for driving without motor insurance should be increased to reflect their seriousness appropriately.
Currently, driving without insurance results in a fixed penalty of £300 and six penalty points. However, if the case proceeds to court, it can lead to an unlimited fine and/or disqualification from driving.
False declaration penalties under review
The consultation also asked participants whether the government should introduce penalty points or driving disqualification for the offence of false declaration to obtain motor vehicle insurance. This includes providing incorrect details such as name, address, or failing to disclose unspent motoring convictions.
According to the consultation, a false declaration can void an insurance policy, especially in the event of a collision. The law treats fraud or deliberate criminal acts severely, and the difference in penalties between making a false declaration and driving without insurance is being considered.
Next steps
The public consultation closed in May 2026, with findings expected to be published in the coming weeks. Any potential legislative changes would occur later in the year, as indicated in the consultation.
