The source further explained that Sandilands remained unaware of the extent of Henderson's anger over the August incident because she never directly addressed it with him. "Dating was on the table at certain times, and he had no idea [she was still upset] because she did not mention anything directly to Kyle," the insider revealed. They defended Sandilands' comments as part of his established on-air persona, stating "Kyle being like, 'I don't know if you're going to find anyone,' that is part of the parameters of the segment."

Text messages presented in court documents show Henderson's growing frustration. On September 10, following another on-air argument, Henderson texted KIIS network head Derek Bargwanna stating "I will not be spoken to the way I was (particularly off air)..." She later expressed concerns that female listeners were complaining about Sandilands' behavior and described their on-air dynamic as "abusive."

He claims his dismissal following the altercation with Henderson cannot constitute serious misconduct because such behavior had been previously encouraged by his employer. Representatives for Kyle Sandilands declined to comment when approached by media outlets.

The court documents reveal that despite Henderson's multiple complaints to executives including Bargwanna, executive producer Natalie Penfold, ARN chairman Hamish McLennan, and managing director Ciaran Davis, the broadcaster allegedly took no substantive action to intervene or address Sandilands' behavior before the relationship completely deteriorated.
